Terms of Service
Effective Date: August 5, 2026
Welcome to Caregiver Dashboard, operated by Care Compass Software, LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms," "Agreement") govern your access to and use of the Caregiver Dashboard application, web portal, services, software, and mobile applications (collectively, the "Services").
By creating an account, accessing, or using the Services, you ("User," "you," or "your") agree to be bound by these Terms and our Privacy Policy. If you are entering into this Agreement on behalf of a care agency, business, or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, do not access or use the Services.
1. Eligibility and Authority
You represent and warrant that:
- You are legally able to enter into this agreement.
- You will use the Service only for lawful purposes.
- If you use the Service on behalf of an organization, you have authority to bind that organization to these Terms.
2. Acceptable Use
You agree not to:
- Use the Service in violation of law, regulation, or another person or entity's rights.
- Attempt to bypass, disable, or interfere with security or access controls.
- Introduce malware or other harmful code.
- Use the Service in a way that could damage, disable, or impair the Service.
3. As-Is and Local Storage Disclaimer
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
Data you enter into the Service is stored locally on your device. The Company does not automatically copy, mirror, or back up your local device data.
You are solely responsible for creating, maintaining, and validating your own device and data backups, including any backups required by your workflow, employer, regulator, or care setting.
4. No Company Backup Custody
The Company does not assume custody of your local-only records unless and until such records are explicitly transmitted to and accepted by a separate Company-controlled backend service that states otherwise in writing.
Unless expressly stated otherwise in a separate written policy, local data loss, corruption, deletion, or device failure remains your responsibility.
5. Encryption Key and Password Disclaimer
The Service uses user-controlled encryption and key material for protected backup and recovery workflows.
The Company does not hold, escrow, recover, reset, or recreate your backup passwords, encryption keys, recovery phrases, or equivalent key material.
If you lose required key material, backup password credentials, or recovery secrets, encrypted data may become permanently unrecoverable. In that event, the Company cannot restore access, decrypt your data, or recover the lost information.
6. Export Verification and Medical Use Limitation
Exported reports, files, summaries, and data extracts are provided for informational and care-coordination purposes only.
You and any participating caregivers or care team members must manually verify the completeness, currency, and accuracy of exported data before relying on it for medical, clinical, medication, treatment, or other health-related decisions.
The Service and its exports are not a substitute for professional medical judgment, diagnosis, or treatment.
7. No Emergency Services
The Service is a historical tracking and documentation tool for care logs, records, and coordination notes. It is not a real-time monitoring system and not an emergency-response service.
The Service is not monitored for emergency events and is not intended to detect, escalate, or dispatch emergency assistance in real time. Do not use the Service for urgent or emergency medical needs. In an emergency, contact local emergency services immediately.
8. Open Source Software and Third-Party Components
The Service may include software, libraries, and other components provided by third parties under open source and other licenses ("Third-Party Components").
Your use of Third-Party Components is subject to the applicable third-party license terms. Applicable notices and licenses are provided in THIRD-PARTY-NOTICES.md and/or other attribution materials distributed with the Service.
If these Terms conflict with any mandatory rights granted under an applicable third-party license for a specific Third-Party Component, the third-party license terms control for that component to the extent of the conflict.
Third-Party Components are provided by their respective authors and licensors on an "as is" basis, and the Company does not provide additional warranties for those components beyond what is required by law.
9. User Responsibility for Safe Use
You are responsible for:
- Maintaining secure access to your device and credentials.
- Keeping your software and device protections up to date.
- Confirming critical care information through appropriate clinical workflows.
- Following all laws, regulations, and organizational policies applicable to your use of the Service.
10. Suspension and Termination
The Company may suspend or terminate access to the Service if it reasonably believes:
- You violated these Terms.
- Your use presents a security, legal, or operational risk.
- Suspension is needed to protect users, the Service, or third parties.
You may stop using the Service at any time.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available," with no warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for any loss, damage, or claim arising from:
- Local data loss or corruption.
- Failure to maintain backups.
- Lost, forgotten, or inaccessible encryption keys or backup passwords.
- Inaccurate, outdated, incomplete, or unverified exported data used for decision-making.
- Any interruption or unavailability of the Service.
- Service disruptions, downtime, degraded performance, delayed delivery, or temporary functionality loss caused by third-party platform infrastructure or dependencies, including Apple App Store services, Google Play services, internet/network outages, mobile carrier failures, device-manufacturer changes, or operating-system-level updates.
To the maximum extent permitted by law, in no event will the Company be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, or goodwill.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and affiliates from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of applicable law.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
Any dispute arising from or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Pennsylvania, unless applicable law requires otherwise.
15. Updates to These Terms
The Company may update these Terms from time to time. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
16. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
These Terms constitute the entire agreement between you and the Company regarding your use of the Service, except where a separate written agreement expressly applies.
